Privacy Policy (Midea Cloud Drive)

Introduction

Your trust is of utmost importance to us, and we understand the importance of personal information to you. We will collect personal information from you in accordance with legal requirements and within reasonable and necessary limits. We will do our utmost to adopt appropriate security measures, including reasonable and effective information security technologies and management processes, to prevent the disclosure, destruction or loss of your information. Therefore, Midea Platform Service Provider (or "we") has developed this Privacy Policy and reminds you to pay attention to the following:
This agreement applies to all products and services provided to you by Midea platform service providers through websites, clients, and new forms that may emerge with technological development. The Midea platform referred to in this agreement refers to the Midea Cloud client, operated by Midea Group Co., Ltd. and its affiliated companies, as well as new forms of clients that may be launched in the future.
If our or affiliated companies' products or services use Midea platform products or services (such as logging in with a Midea platform account), but do not have an independent privacy policy/agreement, this policy/agreement also applies to that part of the product or service. If we or affiliated companies have separate privacy policies/agreements for the products or services provided to you, the corresponding privacy policy/agreement shall apply to the corresponding product or service. If a separate privacy policy/agreement of a certain platform is not fully stipulated, the corresponding provisions of the privacy policy/agreement of other relevant Midea platforms can be referred to.
It should be noted that this agreement does not apply to services provided to you by third parties, such as jumping to third-party websites, clients or programs through Midea platform. The personal information you provide to the third-party service provider is not subject to this agreement.
Before using any products or services provided by Midea Platform, please read this agreement carefully and thoroughly, especially the clauses marked in bold and underlined. You should focus on reading and start using only after fully understanding and agreeing to the terms. If you have any questions about this agreement, you can contact Midea customer service (400-889-9315) or contact us through the contact information provided on any Midea platform. If you are a minor under the age of 18, please read this agreement with the accompaniment of a legal guardian and pay special attention to the terms of use for minors.
This agreement mainly explains to you:

1   Our Role
Our role: We are the controllers of your data. This means that we have the right to decide how to handle your personal information and for what purposes. We understand that you care about how your data is used and shared, and we appreciate your trust in us. We will handle your data with care and prudence.

2   What Information We Collect
We collect your information based on the principles of legality, reasonableness, and necessity. When providing you with a specific service, we will clearly inform you of the information that will be collected and the purpose for which it will be used. Depending on the service you choose, we may collect one or more of the following types of information:
2.1 This product is only open to employees, affiliated units, and suppliers of Midea Group. An account and initial password will only be generated after your information has been maintained through Midea's human resources system. Please log in with your account and password, which you can change yourself.
2.2 When you use your Midea account to log in, we will collect your personal information from Midea's human resources system, including your name, account number, employee number, department, job title, phone number, and email address
2.3 When you use the file upload or download service, you can choose to upload local files such as pictures, videos, and audio from the "My Cloud Drive" entrance on the Midea Cloud Drive homepage. You can also download files that have already been stored on Midea Cloud Drive, and you can choose to set the network conditions for uploading and downloading.
2.4 When you share files externally (such as through links), we will collect information such as the shared file, personal avatar, nickname, and personal identity. To facilitate your file sharing, we provide you with file sharing, file collaboration, and friend and group sharing functions within the cloud drive. You can choose the sharing capabilities you need for file sharing according to your own needs. After sharing files, you can also cancel the sharing according to your needs. The files you choose to share can be set to be visible to all users. If any of your personal information or even sensitive personal information is involved, please consider carefully. If you publish information that involves other people's personal information, you must obtain their consent before making it public. When you publish files/messages to your cloud drive friends & groups, we will collect your personal avatar, nickname, and personal identity, and display your nickname, avatar, published content, and information, or recommend content publishers related to you.
2.5 When you use the search service on Midea Cloud Drive, to fulfill the obligation of network security protection stipulated by laws and regulations, Internet information content management responsibility, and to show you more relevant and interesting content, our server will automatically record your activity information, including the search keywords you enter, text information in pictures and videos, feature information such as classification and location, text information in documents, your display and click records, your device information, and your other log information.
2.6 If Midea Cloud Drive initiates operational activities for newly launched services and functions, such as processing your personal information or applying for device system permissions, and you have not previously authorized consent, we will obtain your separate consent. If the processing involves sensitive personal information, we will obtain your separate consent. We may also collect other information, such as the questionnaire reply information you send to us when participating in a questionnaire survey, or the information you provide to us when participating in a user experience program or interacting with us.
2.7 During your use of our products and services, in order to identify abnormal account or device status, understand or optimize the adaptability of product services, provide application version upgrade or firmware version upgrade services, we will collect your usage information and store it as network log information, including the IP address of the relevant device, operating system version, registration date, and device settings used to access the service.
2.8 When you use Midea's platform products or services, we will automatically receive and record information from your browser and computer, such as your IP address, browser type, language used, access date and time, software and hardware feature information, and web page records you require.
2.9 It should be noted that individual device information and service log information are information that cannot identify a specific natural person. If we combine this type of non-personal information with other information to identify a specific natural person, or use it in combination with personal information, during the period of use in combination, this non-personal information will be considered as personal information. Except for obtaining your authorization or as provided by laws and regulations, we will anonymize and de-identify this information.
2.10 To improve the security of your use of Midea's platform services, protect your or other users' or the public's personal and property safety from infringement, better prevent security risks such as phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, and network intrusions, more accurately identify violations of laws and regulations or Midea's platform-related agreement rules, we may use or integrate your account information, device interaction information, network log information, and information shared with us based on your authorization or according to laws to comprehensively judge the risks of your account and transactions, perform identity verification, detect and prevent security incidents, and take necessary record, audit, analysis, and disposal measures according to law.
2.11 If the personal information you provide contains personal information of other users, you must ensure that you have obtained legal authorization before providing this personal information to us. If we use information for purposes not specified in this agreement, use information collected for specific purposes for other purposes, or actively obtain your personal information from third parties, we will obtain your consent in advance.
2.12 Exceptions to obtaining authorization: You fully understand and agree that we may collect and use your personal information without your authorization in the following circumstances, and we may not respond to your requests for correction/modification, deletion, cancellation, revocation of consent, or information retrieval:
2.12.1 Related to national security and national defense security;
2.12.2 Related to public safety, public health, and major public interests;
2.12.3 Related to criminal investigation, prosecution, trial, and execution of judgments by judicial or administrative law enforcement;
2.12.4 Necessary to protect your or other individuals' vital legal interests but difficult to obtain your consent;
2.12.5 Personal information you have voluntarily made public to the public;
2.12.6 Collecting personal information from legally disclosed information, such as legal news reports, government information disclosure, and other channels;
2.12.7 Necessary for signing and performing relevant agreements or other written documents with you;
2.12.8 Necessary to maintain the safe and stable operation of the provided products and/or services, such as discovering and disposing of product and/or service faults;
2.12.9 Necessary for legal news reporting;
2.12.10 Necessary for academic research institutions to conduct statistics or academic research based on public interests, and to de-identify personal information contained in the results when providing academic research or describing the results to the public;
2.12.11 Other circumstances stipulated by laws and regulations.

3   How we use Cookies and Similar Technologies
We and third-party service providers use technologies such as Cookies, tags, and scripts to better understand user behavior (including for security and fraud prevention purposes), tell us which parts of our website users have browsed, measure the effectiveness of advertisements and online searches, and improve them.
3.1 Necessary Cookies: These Cookies must be set in order to provide you with specific functionality or services that you have requested. For example, we need to use them to display the website in the appropriate format and language.

4   How We Use Your Information
4.1 We will keep your personal data up-to-date, store or destroy it securely, minimize the collection and retention of data we need to provide you with services, protect personal information from unauthorized disclosure, misuse, and unauthorized access, and take appropriate technical measures to protect the security of your personal information.
4.2 We will use your information for the following purposes:
4.2.1 To provide you with services (such as office services) in accordance with the contracts we have signed with you.
4.2.2 To fulfill your service requests, including making changes at your request or providing you with requested information and technical support.
4.2.3 To send you information, notifications, and other messages related to our group; to invite you to participate in surveys, sign up for events, etc. If you do not want to receive such information, you can unsubscribe using the platform's unsubscribe function.
4.2.4 To provide other services you have requested in accordance with the requirements stated when we collected the information.
4.2.5 To share your contact information with our branch offices around the world for internal management and backend support.
4.2.6 To maintain the integrity and security of the data technology systems in which we store and process your personal information.
4.2.7 To enforce or protect our agreements or contracts signed with you.
4.2.8 To detect and investigate information leaks, illegal activities, and fraudulent behavior.
4.2.9 To contact you to resolve issues.
4.2.10 For other purposes with your permission.
4.3 It should be noted that the above usage methods cover the main ways we use your information. We may provide users with more diverse services from time to time through updating website pages, client versions, etc. When we use information for other purposes not specified in this agreement, or when we use information collected for specific purposes for other purposes, we will seek your consent again through signing agreements, pop-up prompts, updating this agreement, etc.

5 When We Share Your Information
We will not share your personal information with any companies, organizations, or individuals outside of Midea, except in the following cases:
Sharing in legal situations: We may share your personal information with external parties in accordance with the requirements of laws and regulations, litigation dispute resolution needs, or requests from administrative or judicial authorities.
5.2 Sharing with explicit consent: After obtaining your explicit consent, we will share your personal information with other parties.
5.3 Sharing with affiliated companies: In order to provide products and services to you, identify account anomalies, protect the personal and property safety of other users or the public, your personal information may be shared with our affiliated companies and/or their designated service providers. We will only share the necessary personal information and will be bound by the purposes stated in this agreement. If we share your sensitive personal information or our affiliated companies change the purpose of using and processing personal information, we will seek your authorization and consent again.
5.4 Sharing with authorized partners: We may authorize partners to provide certain services to you or perform functions on our behalf. We will only share your information for legitimate, lawful, necessary, specific, and clear purposes stated in this agreement. Authorized partners can only access the information they need to perform their duties and cannot use this information for any other purpose. We do not need to notify you separately and obtain your consent for the use and sharing of processed data after such processing by third-party SDKs. Currently, our authorized partners include the following types:
5.4.1 Advertising and analysis service partners. Please be aware that in order to provide you with more convenient, high-quality, and personalized products and/or services, and improve your user experience, we may entrust these partners to process information related to advertising coverage and effectiveness. However, we will not provide your personal identity information, or we will de-identify this information so that it cannot identify you personally. These partners may combine the above information with other data they legally obtain to perform the advertising services or make decisions we entrust them with. 5.4.2 Suppliers, service providers, and other partners. We will send information to suppliers, service providers, and other partners who support our business, including technical infrastructure services provided by us, analyzing the way our services are used, measuring the effectiveness of services, providing customer service, facilitating payments, or conducting academic research and surveys. In order for you to use the above services and functions, our applications may embed the SDKs or other similar applications of authorized partners. For third-party SDK use, we will authorize partners to obtain business information based on the premise of not synchronizing user personal data. At the same time, for third-party SDK application programming interfaces (APIs) and software development kits (SDKs), we will conduct strict security checks and sign strict data protection agreements with partners to ensure that they process personal information in accordance with our entrusted purposes, service descriptions, this privacy policy, and any other relevant confidentiality and security measures.
5.5 We will not transfer your personal information to any company, organization, or individual, except in the following cases:
5.5.1 Transfer with explicit consent: After obtaining your explicit consent, we will transfer your personal information to other parties.
5.5.2 In the event of a merger, acquisition, or bankruptcy liquidation of Midea's platform service provider or any other situation involving a merger, acquisition, or bankruptcy liquidation, if it involves the transfer of personal information, we will require the new company or organization holding your personal information to continue to be bound by this agreement. Otherwise, we will require the company, organization, or individual to seek your authorization and consent again.

6 Disclosure
We will only disclose your personal information in the following circumstances:
6.1 With your consent.
6.2 Based on legal disclosure: in the event of a mandatory request from a legal, judicial, or government regulatory agency, we may disclose your personal information.

7 How we store your information
In accordance with legal requirements, the personal information we collect and generate within the territory of the People's Republic of China will be stored within the territory of the People's Republic of China. We will not transmit or store your personal data across borders. Unless otherwise required by law, Midea will retain your information for the following periods:
7.1. During your use of our cloud storage products or services, we will continue to retain your information.
7.2. We will back up the collected information regularly in accordance with Midea Group's data backup strategy.
7.3. When you are employed by or have business cooperation with Midea, you cannot cancel your account on this platform. When you are no longer employed by or have ended business cooperation with Midea, we will revoke your login account and freeze your account. In accordance with legal requirements, we will continue to retain your relevant personal data in the background, but we will not use it for purposes other than this agreement.
7.4. Your personal information that has been anonymized and desensitized will form circulating data that can be used. Midea does not need to obtain your consent separately for the storage and use of this data.
7.5. When our products or services cease to operate, we will notify you through push notifications, announcements, and other forms, and delete your personal information or anonymize it within a reasonable period of time.

8 How we protect your information
8.1. We have adopted security measures that meet industry standards and are reasonably feasible to protect your information from unauthorized access, disclosure, use, modification, damage, or loss. For example, data exchange between your browser and our server is protected by SSL protocol encryption; we also provide HTTPS protocol secure browsing for all Midea platform websites; we use encryption technology to enhance the security of personal information; we use trusted protection mechanisms to prevent malicious attacks on personal information; we deploy access control mechanisms to ensure that only authorized personnel can access personal information; and we hold security and privacy protection training courses to enhance employees' awareness of the importance of protecting personal information.
8.2. The Internet is not an absolutely secure environment. When using Midea's products or services, we strongly recommend that you do not use communication methods recommended by non-Midea platforms to send your information. You can establish contact and share with each other through our services. When you create communication, transactions, or sharing through our services, you can choose the objects to communicate, trade, or share with, as a third party that can see your transaction content, contact information, communication information, or sharing content, and other relevant information. 8.3. In the event of a personal information security incident, we will inform you in accordance with legal and regulatory requirements: the basic situation and possible impact of the security incident, the disposal measures we have taken or will take, suggestions for you to take self-prevention and risk reduction, and remedial measures for you. We will inform you of the incident-related information through email, letter, telephone, push notifications, and other means. If it is difficult to inform each individual information subject one by one, we will adopt reasonable and effective methods to issue public announcements. At the same time, we will also report the disposal of personal information security incidents in accordance with the requirements of regulatory authorities.

9 Your rights
You have the right to manage your information, including:
9.1. Access to your personal information:
9.1.1. Account information: If you wish to access or edit personal information in your account, change your password, etc., you can log in to your account and access or edit it through settings and other means.
9.1.2. Other personal information (such as when using file sharing): For personal information generated during your use of our products or services, you can contact us through the contact information provided in Chapter 9.
9.2. Correct your personal information
When you find that we have processed your personal information incorrectly, you have the right to request that we make corrections or supplements. You can correct or supplement through the personal information settings page or contact us directly.
9.3. Delete your personal information
In the following situations, you can contact Midea platform customer service to request the deletion of personal information:
9.3.1. If our processing of personal information violates laws and regulations.
9.3.2. If we collect and use your personal information without obtaining your explicit consent.
9.3.3. If our processing of personal information seriously violates our agreement with you. 9.3.4. If you no longer need to use our products or services, or you voluntarily cancel your Midea account.
9.3.5. If you will never need us to provide products or services permanently. If we decide to respond to your deletion request, we will stop providing products or services to you and delete your personal information in accordance with applicable laws.
9.4. Right to withdraw consent When we rely on your consent to process data, you have the right to withdraw that consent at any time, specifically by canceling your Midea account to withdraw your consent.

10 Account cancellation by personal information subjects
10.1. You can cancel the account you registered at any time. If you need to do so, you can contact us through the contact information provided in Chapter 9 to cancel your account as a personal information subject.
10.2. After you cancel your account, we will stop providing products or services to you and, according to your request, delete your personal information.

11 Protection of information of minors
11.1. Our products and services are mainly aimed at adults. In the case of collecting personal information of minors with the consent of legal guardians, we will only use or disclose the legally collected personal information of minors when permitted by law, with the explicit consent of legal guardians, or when necessary to protect minors.
11.2. If we find that personal information of minors has been collected without the prior consent of legal guardians, we will try to delete the relevant data as soon as possible. If legal guardians have reason to believe that minors have submitted personal information to the Midea platform without their prior consent, please contact us to ensure the deletion of such personal information and ensure that minors unsubscribe from any applicable Midea services.

12.2. To ensure security, you may need to provide a written request or other means to prove your identity. In general, we will reply within 15 days. If you are not satisfied with our response, especially if you believe that our processing of personal information has harmed your legal rights, you can also complain or report to regulatory authorities such as the Cyberspace Administration, Telecommunications Administration, Public Security, and Market Supervision.
12.3. If you are not satisfied with our response, especially if you believe that our processing of personal information has harmed your legal rights, you can also seek a solution by filing a lawsuit with a court having jurisdiction over the defendant's domicile.

13 Terms Update
13.1. In order to provide you with better services and a better user experience, this agreement may be changed in a timely manner according to business adjustments, changes in laws and regulations, or policies. If you continue to use any of our services or access our related websites after the privacy policy is adjusted or changed, we believe that this represents that you have fully read, understood, and accepted the modified privacy policy and are bound by it.
13.2. This privacy policy is updated at least once every 12 months. This update was made on April 30, 2023.
